Convicted former President Menem for arms smuggling

MEXICO, DF (Ap). - An appeals court found guilty of Argentina
President Carlos Menem, 82, of the crime of aggravated smuggling 6,
500 tons of arms and ammunition to Croatia between 1991 and 1995 and
Ecuador in full Cenepa conflict.
The judgment of the Court of the National Chamber of Criminal
Cassation also reached the former Minister of Defense Camillón Oscar,
and the penalty for two former officials be determined by the Oral
Criminal Court Economic 3 (TOPE3), which had acquitted.
The Court overturned the acquittal of Menem and Camillón but
confirmed the presidential exasesor excuñado Menem, Emir Yoma.
The judges of the Chamber of Madueño Raul, Luis María Cabral y Juan
Carlos Gemignani, also acquitted Muzi and Enrique Julio Mauricio
Tower while the former head of the Air Force, Juan Paulik, he
affirmed the dismissal prescription
The case came at the request of the House after the Attorney
General's Office and the Customs Argentina appealed the judgment of
September 13, 2011 by TOPE3 acquitted all the accused.
During the Menem government 6,500 tons of weapons were exported
destined for Panama and Venezuela officially. They were diverted to
Croatia in 1991, in the conflict in the former Yugoslavia, and
Ecuador, in 1995, when Argentina was a guarantor in Cenepa conflict
with Peru.
The guns, rifles and other supplies shipped in Buenos Aires were
diverted in a scheme to circumvent the arms embargo being imposed on
Ecuador and Croatia, because both were involved in armed conflict at
the time.
At trial, the former president and current senator denied any
responsibility in the illegal sale of weapons and argued that during
his tenure "merely signed decrees on arms exports" to Venezuela and
Panama, and that "all procedures beyond the President ".
As a senator, Menem in Argentina enjoys immunity which protects him
from stepping directly to jail except that promotes a political trial.
Argentine laws provide for sentences of five to fifteen years in
prison for the crime of smuggling weapons, however, defenders of the
president has already predicted that it will appeal the ruling.
