A 50-year-old local man who was accused of sexually abusing a young girl was sentenced to 7.5 years in prison followed by a lifetime of supervised probation.

Albert Bermudez was sentenced Aug. 27 by Judge Thomas Fink of Santa Cruz County Superior Court after he was convicted of sexual abuse, a Class 3 felony, and child molestation, a Class 2 felony. Bermudez pleaded "no contest" to the charges, which has the same legal effect as a guilty plea.

The judge gave Bermudez credit for 119 days served prior to his sentencing.

On March 3, 2014, the victim's mother reported that her then 11-year-old daughter came forward about the abuse, stating that it began when she was 8 or 9 years old and continued on more than five occasions until October 2013, according to the pre-sentence report.

The victim's mother added that Bermudez was incarcerated at a federal prison in Mexico on February 11, 2014 for attempting to cross a high-powered rifle into Mexico, and she believed her daughter had found the courage to come forward because Bermudez was safely behind bars.

Bermudez was released from Mexican prison in March 2018, according to the pre-sentence report, and was apprehended for other warrants in Pima County on April 23, 2018.

Bermudez told a probation officer during his pre-sentence interview that violent incidents in the Mexican prison caused him to suffer memory loss, and so he didn't recall ever abusing the victim.
"I don't remember anything. It feels like a dream, like I lost my life," he reportedly said.

However, the report writer noted that Bermudez had no issues with responding other questions about his personal life.

During the delivery of persons, the Mexican government also handed over four US prisoners, three of them responsible for crimes against health and one for robbery.

The PGR reported that the reception delivery was carried out in compliance with the constitutional norms and the bilateral treaty.

Once in national territory, the nationals were transferred to a penitentiary center in our country to carry out their social reintegration, as established by law.

"The international transfer of a convicted person seeks, with the express consent of the inmate, as an indispensable requirement, that he be transferred to his country of origin in compliance with a benefit and a human right protected and safeguarded by our Magna Carta," the PGR.

The PGR explained that the international transfer of sentenced persons is a procedure that does not require the hiring of a private attorney or specialist in the matter, since the General Directorate of International Procedures of the Legal and International Affairs Deputy Attorney General, in coordination with the consulates of Mexico advises, informs and follows up on these requests for free.
